RESOLUTION NO. 1992-09

RE: TREAlY NO. 9-IAND, WATER AND NATURAL RESOURCES

WHEREAS 1905 James Bay Treaty No.9 is one of the unique government to government relationship treaties that was signed between Ontario with the direct input of Canada and our ancestors of the western James Bay and surrounding areas;

AND WHEREAS the current generation of the descendants of the Treaty No. 9 signatories and other aboriginal citizens of the time who were also present in the signing of Treaty No. 9 in 1905 do wish to retain this special government to government relationship today;

AND WHEREAS this special relationship will be used as a basis of negotiating the intent and spirit of Treaty No. 9 as understood by our ancestors and to negotiate for the development and implementation of our community-based and locally autonomous aboriginal self-government institutions in our respective communities of western James Bay and surrounding areas;

AND WHEREAS the current structure and function of Mushkegowuk Council may not be set up to effectively respond and to deal with the intent and spirit of Treaty No. 9, nor was it designed for the development of aboriginal self-government institutions which would be developed and managed by our local Treaty No. 9 communities;

AND WHEREAS it is the desire and directional position of the Treaty No. 9 First Nations of the western James Bay and surrounding areas that they wish to establish a more solid aboriginal self­government organizational support system with which to promote the implementation of Treaty No. 9, the promotion of Aboriginal self-government and for the management purposes of their lands, water and other natural resources of their territories;

THEREFORE BE IT RESOLVED THAT the following tasks be immediately undertaken by the newly-elected Chairperson of Mushkegowuk Council;

In direct consultation with the Chiefs and Councils of the Treaty No. 9 communities directly affected, to determine and establish ways and means of how the current Mushkegowuk Council might be strengthened in name, mrssron statement, objectives, work plans and Constitutional by-laws to better reflect the Treaty No.9, our inherent rights of aboriginal self-government, community based land and

resources management practices and for the development and implementation of our community based and locally autonomous aboriginal government systems.

The names of such terms as Chief(s), Chairperson, Councillors, Tribal Councils and other terminologies be reviewed and considered for changes that would better reflect the cultural and language traditions of the First Nations of western James Bay and surrounding areas.

To review and determine how much public funding and by what contribution agreements that Ontario and Canada is providing for the various aboriginal groups and organizations in which such funding is intended for the benefit of some of our citizens living on and off our reserve territories locally and across Ontario

To determine the extent to which Nishnawbe-Aski Nation, Chiefs of Ontario office, and by what contribution agreements for the various aboriginal groups and organizations, which funding is intended for the benefit of some of our citizens of the western James Bay communities who are living both on and off our reserve territories locally and across Ontario.

Once the above tasks have been dealt with, the Chairperson shall report directly to each Treaty No. 9 First Nation Band Council affected for the purpose of initiating organizational and planning tasks to satisfy the aborigi n a I self­government aspirations and land, water and natural resources initiatives of the First Nations of Treaty No. 9 and of the surrounding areas; this position and report would then be presented to the Assembly of the Band Councils of the James Bay Treaty No. 9 communities for collective action and further decisions.

The Chairperson shall use all means possible to complete the above­noted tasks by December 31, 1992.
