RESOLUTION NO. 1993-07

Hydroelectric Development

WHEREAS the Minister

Environment and Energy

offered an overall approach

hydroelectric development in

Moose River/James Bay Basin,

letter dated May 20, 1993;

AND WHEREAS the approach includes a binding agreement that no hydroelectric development will occur within the basins of the Attawapiskat, Albany and Weenusk Rivers without the consent of the affected First Nation (and no development at all greater than 25 MW);

AND WHEREAS the approach includes binding agreement that no hydroelectric development will occur within the Moose River basin north of Highway 11 (except Hydro's Mattagami Extensions) until a co-planning process has been agreed to by Moose Factory First Nation and New Post First Nation;

AND WHEREAS the approach includes a new process to review Hydro's Mattagami Extension to achieve environmental enhancement;

AND WHEREAS the appropriate structures need to be developed and agreed to by all First Nations;

MUSHKEGOWUK COUNCIL ASSEMBLY RESOLUTION

AND WHEREAS the technical staff of Mushkegowuk Council have developed a draft reporting structure to be considered by First Nations;

AND WHEREAS the financial resources have been identified by Ontario to assist in the process, including resources for negotiations and legal counsel;

AND WHEREAS there is a need to determine timef rames for completion of negotiations;

THEREFORE BE IT RESOLVED that the Mushkegowuk Council supports the approach in the Minister's letter of May 20, 1993 subject to conditions that individual First Nations may choose to impose and provided this is not necessarily an acceptance of the Mattagami extension;

AND BE IT FURTHER RESOLVED that the recommendations surrounding structures, negotiations, and legal and scientific and technical resource people be adopted immediately.
