RESOLUTION NO. 1999-09-12

CHA PLEAU CREE AND MISSANABIE CREE TRADITIONAL HUNT

WHEREAS the people of the Chapleau Cree First Nation and the Missanabie Cree First Nation have hunted since time immemorial in their traditional territories;

WHEREAS the people of the Chapleau Cree First Nation and the Missanabie Cree First Nation made a solemn Treaty in 1905/6 with representatives of the British King, the government of Canada, and the government of Ontario, in which the King and governments recognized and undertook to respect and protect, forever, the right of the Cbapleau Cree First Nation and the Missanabie Cree First Nation to continue hunting in their traditional territory as a key paii of their economy and way of life;

WHEREAS the Treaty discussions and agreements never contemplated or ceded permission to Canada or Ontario to create complete and total hunting bans over portions of the Chapleau Cree and Missanabie Cree traditional territory;

WHEREAS the province of Ontario established, according to its own laws but in conflict with the Treaty, a wildlife sanctuai-y in Chapleau Cree and Missanabie Cree traditional territory, in which sanctuai-y all hunting of any kind and at any time is prohibited;

WHEREAS the purported wildlife

sanctuary was established without consulting with or obtaining the consent of the Chapleau Cree First Nation or the Missanabie Cree First Nation;

WHEREAS the Chapleau Cree First Nation and Missanabie Cree First Nation have organized a traditional hunt for this fall in the part of their traditional territory claimed by Ontario to be within the wildlife sanctuary;

THEREFORE BE IT RESOLVED that the assembled Chiefs and delegates of the Mushkegowuk Council express their deepest concern that the game sanctuary in Chapleau Cree and Missanabie Cree traditional territory was established and continues to exist in contravention of the solemn Treaty promises and agreements made by Ontario and Canada; and

AND BE IT FURTHER RESOLVED that the assembled Chiefs and delegates of the Mushkegowuk Council acknowledge the validity under traditional Cree custom and law of the hunt in the wildlife sanctuary planned by the Chapleau Cree and Missanabie Cree.
