Resolution No. 2010-09-29

Oral Treaty Promises and Possible Legal Action

WHEREAS the Mushkegowuk people have always heard the history of our Treaty from our Elders, who have described how we did not give up our rights to the homeland in which we have always lived; and

WHEREAS this Assembly/Mamohitowin has heard the description of the oral promises and agreements made at Treaty time, as shown in the diaries of Treaty Commissioners recently discovered and other documents, and heard how these records confirm the histories told us by our Elders; and

WHEREAS these oral promises continue the promise made in the Rupertsland Protection Pledge by the Parliament of Canada; and

WHEREAS it has always been the desire of the Mushkegowuk people and continues to be our determination to defend our rights in our homelands;

THEREFORE BE IT RESOLVED that this Mamohitowin of the Omushkegowuk support the continued review of possible legal action to defend our homeland and our rights, based on the oral Treaty promises and

agreements, as confirmed by the Treaty Commissioners diaries and other documents, and by the Rupertsland Protection Pledge; and

BE IT FURTHER RESOLVED that the Mushkegowuk Councils' legal counsel be directed to review detailed legal options with the Mushkegowuk Chiefs, and that the Mushkegowuk Chiefs be authorized, if they believe it is wise and appropriate, to formally begin legal action on the oral Treaty promises, as well as the Rupertsland protection promise, to defend our homeland; and

BE IT FURTHER RESOLVED that the Mushkegowuk Council Office of the Grand Chief be directed to convene a meeting within the coming months of the Chiefs and other advisors as the Grand Chief deems necessary to review in detail possible next legal steps.
