INHERENT AND TREATY RIGHTS TO HEALTH CARE

WHEREAS The Treaty Nations and their citizens of the Mushkegowuk First Nations will forever uphold the real Treaty No. 9 Agreement in the highest honour and respect; and

WHEREAS based on our understanding and interpretation of the real Treaty No. 9 Agreement, that our health care system is an inherent Treaty right; and

WHEREAS the real Treaty No. 9 Agreement reaffirms the Treaty Nations of the Mushkegowuk First Nation's inherent right to self-government, includes the right to establish legislation and required institutions for health care; and

Therefore be it resolved that; as our Treaty partners, the Chiefs and delegates of this Kihchinaskishatowin of the Omushkegowuk encourages Weeneebayko Area Health Authority to take an important step by acknowledging and recognizing the real Treaty No. 9 Agreement within their governance policies; and

Therefore be it further resolved that; In exercising our Inherent and Treaty Rights to health, as understood and

interpreted by the Omushkegowuk, the Chiefs and delegates of this Kihchinaskishatowin of the Omushkegowuk directs all governments and health service providers to recognize our real Treaty No. 9 agreement as the foundation for our health care system and the transformation of our health care; and

Therefore be it further resolved; that the Chiefs and delegates of this Kihchinaskishatowin of the Omushkegowuk mandates the Office of the Grand Chief to a) initiate a community-based process to develop Omushkego Laws for our Health Care System and b) the mandate will include, but not be limited to, research, documenting, developing and designing an implementation process for Omushkego Laws.
