OMUSHKEGO NATION HEALTH ACT (LEGISLATION)

WHEREAS the real Treaty No. 9 Agreement reaffirms the Treaty Nations of the Mushkegowuk First Nation's inherent right to self-government, including the right to establish legislation and required institutions for health care; and

WHEREAS for decades the

Omushkegowuk reaffirmed that the governance of our health care system and other essential services must be under our governance and jurisdiction; and

WHEREAS through the development, negotiation and implementation of the Weeneebayko Area Health Integration Framework Agreement, an attempt wŁs made to improve health care services for our region, including the governance of our health care services, but we remain in a health crisis and in a critical need for transformation; and

Whereas Nishnawbe Aski Nation's "Charter of Principles" is the umbrella vision for Health Transformation that recognizes and respects the cultural and linguistic diversity, and autonomy of First Nations within NAN Territory; and our real Treaty No. 9 Agreement within their governance policies; and

WHEREAS Nishnawbe Aski Nation has been mandated to undertake a Health Transformation process for the Nishnawbe Aski Nation communities, including the Mushkegowuk First Nations, and this process needs to be among many other guiding principles, "community driven and First Nations controlled"; and

Therefore be it resolved that: the process for Health Transformation within Mushkegowuk Territory will be determined by the Mushkegowuk people consistent with the real Treaty 9 Agreement; and

Therefore be it further resolved that: For decades, the Treaty Nations of the Mushkegowuk Council have demanded and deserve full control of our health care system and the Chiefs and delegates of this Kihchinaskishatowin of the Omushkegowuk call on Canada and Ontario to honor our inherent and Treaty rights to be self-governing in our health services; and

Therefore be it further resolved; that the Chiefs and delegates of this Kihchinaskishatowin of the Omushkegowuk directs the Office of the Grand Chief to advance the development of an Omushkego Nation Health Act that is inclusive of our Health Care System, and to present a draft version of the proposed Omushkego Nation Health Act at the next Mamowihitowin of the Omushkegowuk.
